Pinky’s Aggregates, Inc., and its president, Dale Honsey, appealed the grant of summary judgment awarding Frontier Fiscal Services, LLC, $526,253.12 in its action for breach of contract and to collect on a personal guaranty. Because Pinky’s and Honsey failed to raise a genuine issue of material fact to preclude summary judgment, the North Dakota Supreme Court affirmed summary judgment.
